Welcome to Nominal (“Nominal,” “we,” “us,” “our”). We operate this website and online store, including all related content, features, products, and services (collectively, the “Services”), to provide a curated and intentional shopping experience. Our store is powered by Shopify.

By visiting, interacting with, or purchasing through our Services, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy ([insert Privacy Policy link]). If you do not agree, please do not use the Services.

1. Access and Account

By using our Services, you represent that you are at least the age of majority in your place of residence and you consent to allow any of your minor dependents to use the Services under your supervision.
You agree that all information you provide (including billing, payment, and shipping) is accurate and complete. You are responsible for maintaining the confidentiality of your account and all activity that occurs under it. Nominal reserves the right to refuse service, terminate accounts, or cancel orders at our discretion.

2. Our Products

Each piece from Nominal is part of a limited and carefully curated release. We strive to represent our products as accurately as possible; however, colors, textures, or finishes may vary slightly due to device settings or lighting.
All descriptions, prices, and availability are subject to change at any time without notice. We may discontinue products or limit quantities at any time.

Limited Drops — The Gates:
Items released through The Gates are limited-edition and exclusive. Except in cases of verified damage or fulfillment error, all sales from The Gates are final. See our Return Policy for details.

3. Orders

Placing an order constitutes an offer to purchase. We may accept or decline any order at our discretion, even after payment authorization. If we cancel or modify an order, we’ll attempt to notify you using the email or phone provided at checkout.

All purchases are for personal use only and not for resale or export. We reserve the right to refuse or limit quantities purchased per person, household, or order.
Your order is not considered accepted until payment is successfully processed and confirmed.

4. Prices, Taxes, and Billing

Prices are displayed in U.S. dollars and may change without notice. The price charged for a product will be the price in effect at the time of purchase. Unless otherwise stated, prices do not include shipping, taxes, duties, or import fees.

International customers are responsible for any customs duties, VAT, or import charges incurred upon delivery.

You agree to provide accurate and current payment information. By submitting payment, you authorize us and our payment processors to charge the total order amount, including taxes and fees. We reserve the right to refuse or cancel any transaction suspected of fraud or unauthorized use.

5. Shipping and Delivery

Shipping times are estimates only and are not guaranteed. Once an order has been transferred to the carrier, title and risk of loss pass to you.
We are not responsible for carrier delays, customs processing, weather events, or any circumstances beyond our control. Please ensure your shipping information is correct at checkout, as we cannot modify it once your order is processed.

6. Intellectual Property

All materials on our Services—including text, graphics, logos, images, product designs, and site layout—are owned by Nominal or its licensors and protected under U.S. and international laws.
You may access and use the Services for personal, non-commercial purposes only. No license or rights are granted except as expressly stated in these Terms. Unauthorized use may violate intellectual property laws.

7. Optional Tools and Third-Party Links

We may offer access to third-party tools or websites over which we have no control. These are provided “as is” without warranties or endorsements. Your use of any third-party service or website is at your own risk and subject to their terms of service.

8. Relationship with Shopify

Our store is hosted on Shopify, which provides the e-commerce platform enabling our Services. However, any purchase you make is directly with Nominal, not Shopify. Shopify is not responsible for your transactions, products, or services offered through our store.

9. Feedback and User Content

If you submit feedback, suggestions, reviews, or other content (“Feedback”), you grant Nominal a perpetual, worldwide, royalty-free license to use, reproduce, and display that Feedback for any purpose, including improving the Services. You represent that you own or have the rights to all content you submit and that it does not infringe upon any third-party rights.

10. Marketing Communications

By providing your email or phone number, you consent to receive transactional messages related to your orders and, if you opt in, promotional content. You may unsubscribe at any time via the link in our emails or by replying STOP to text messages. Message and data rates may apply.

11. Prohibited Uses

You agree not to use our Services:

  • For unlawful or fraudulent purposes

  • To infringe on intellectual property rights

  • To transmit malware or spam

  • To collect data or interfere with site operations

  • To misrepresent your identity or impersonate others

We may suspend or terminate your access for violating these Terms.

12. Errors and Inaccuracies

13. Returns and Final Sale

Our Return Policy governs all return and replacement requests.
Because each release from The Gates is limited and exclusive, all sales are final except in cases of:

  • Damage during shipping

  • Manufacturing defects

  • Fulfillment errors (incorrect item or size)

You must contact us within 7 days of delivery at support@nominalclothing.com with your order number and photos of the issue for resolution.

14. Disclaimer of Warranties

Except as expressly stated by Nominal, the Services and all products are provided “as is” and “as available.”
We make no warranties, express or implied, regarding merchantability, fitness for a particular purpose, durability, or non-infringement. We do not guarantee uninterrupted or error-free operation of the Services.

15. Limitation of Liability

To the fullest extent permitted by law, Nominal and its affiliates, officers, employees, and service providers are not liable for any indirect, incidental, special, or consequential damages, including lost profits, data, or revenue, arising out of your use of the Services or products.
Our total liability to you for any claim shall not exceed the amount paid for the product in question or $100 USD, whichever is greater.

16. Indemnification

You agree to indemnify and hold harmless Nominal and its affiliates, officers, employees, and agents from any claim or demand, including reasonable attorneys’ fees, made by a third party due to your breach of these Terms or your misuse of the Services.

17. Force Majeure

We are not responsible for any failure to perform or delay caused by events outside our reasonable control, including natural disasters, labor disputes, shipping delays, pandemics, or governmental actions.

18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

19. Waiver and Entire Agreement

Failure by Nominal to enforce any provision does not constitute a waiver. These Terms and all policies referenced herein (including our Privacy and Return Policies) constitute the entire agreement between you and Nominal.

20. Assignment

You may not assign or transfer your rights under these Terms without our written consent. Nominal may assign its rights without notice.

21. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law principles. You agree to exclusive jurisdiction and venue in the state and federal courts located in Los Angeles County, California.

22. Changes to Terms

We may update these Terms periodically. Updates take effect upon posting to our website. Your continued use of the Services after changes take effect constitutes acceptance of the new Terms.
